KALAH MENANG PERKARA BIASA...

Salam kenkawan..

Lama tak update. Agak busy dengan tugasan. Sejak akhir2 ini bertubi2 tugasan baru muncul..lepas PRU nanti lagi lah bertambah2 agaknya.. Itupun kalau yang sedia memerintah berjaya mendapat mandat sekali lagi. Kalau sebaliknya, mungkin kami semua akan di'NYAHBERSIH'kan... tootttttt...hehehe

Semalam boss turun padang mengendalikan satu kes. Sebelum ini boss minta mokcik handle. Syukur juga beberapa minggu lalu dia menyatakan hasrat untuk turun padang sendiri. Azwa dan seorang rakan lagi membantu dia. Berkampunglah kami di medan peperangan seawal jam 8 pagi sehingga jam 3.30 petang. Namun keputusannya agak tidak memberangsangkan walaupun bersungguh-sungguh boss cuba meyakinkan mereka yang di atas itu. Keputusannya, rayuan kedua-dua pihak ditolak tanpa kos... agak mengecewakan, tapi sekurang2nya kami sudah mencuba yang terbaik. Apa pun boss, terima kasih kerana memberi pengajaran yang berguna kepada kami. Kita sudah memberikan yang terbaik, dan mencuba sedaya upaya kita..tetapi keputusan di tangan orang lain.        

Dalam kesedihan tu, terselit juga kegembiraan. Ingat tak kes yang mokcik kena marah dengan boss dalam kisah 'ADAT DUNIA' tu? Ding dong ding dong...berjaya juga akhirnya menyelesaikan kes itu dengan jumlah yang jauh lebih rendah daripada yang dijangkakan. Tak apalah boss, berbaloilah boss kena marah dengan boss besar...akhirnya berjaya kita selesaikan satu kes..less one headache..

Oklah..tengah pening nak adjust e-filing ni..korang dah submit ker??

ADAT DUNIA..

Baru jer nak happy happy sebab team Azwa berjaya memenangi suatu kes yang jikalau dilihat dari sudut keterangan, tidak memihak kepada kami. Tapi atas sebab2 kesilapan strategi oleh pihak penuntut, kami berjaya meyakinkan Mahkamah untuk memihak kepada kami..

Kringg..kringgg...

"Helloo.."

"Hello puan..Boss nak jumpa"

Mokcik seperti biasa membawa buku nota, pen dan beberapa tugasan yang memerlukan arahan lanjut bos menuju ke bilik bos.

"Boss.."

"Who prepared this calculation for this settlement?"

"The file officer in charge, boss"

"Where is he?"

"He went for a meeting at the the new building, boss"

"Where did they get this figure?"

"From their discussion with the relevant parties, boss."

"What is the basis for this calculation?? and why you put this note down here?? Do you think the * Tooot* is stupid?? He asked me why the price for the *toot* is too high?? And because of your notes.. do you mean to say we are compensating him for the price of a new *tootttt* and  at the same time we are also giving him cost for recovery??"

"Boss, this is the amended sum,  the inital sum as per my previous offer for settlement is half of this sum. We took into consideration the depreciation value of the *toot*. There is no question of recovery here because the *toot* was a total loss. "

"Why do we put such a huge figure here?? So embarrassing you know. I so malu you know. He yelled at me infront of everbody ......pot pet pot pet pot pet pot pet.."

Mokcik just stand there say nothing.  

Flash back. Few weeks back.

"Boss, here is our proposal for settlement of this matter.

the Plaintiff asking for RM1 Million. However, they are willing to accept around RM700k."

"Then why you put your proposal for RM300k only? what if the plaintiff doesnt accept it? I thought of asking for a mandate around RM500k."

"We took into consideration the depreciation value of the *toot* sir. But we still can ask for mandate below RM500k."

"yes but if you put the figure RM300k here then he will stick to that figure. Go amend this."

Which we did according to boss instruction... sekarang dah kena marah dengan big boss, dia salahkan mokcik pulak...alahaiii..

Back to the future...

"Pot pet pot pet I cannot trust your work anymore..pot pet pot pet..He agreed to this figure because he trusted me you know..pot pet pot pet.. go to court and offer them RM300k only pot pet pot pet.."

"Ok. Thank you Boss.."

Boss just stared at me, and I quickly went out from there..

Semasa lalu depan PA boss, PA boss buat muka menunjukkan rasa kasihan kat Mokcik.. Mokcik senyum kelat jer laa...

Semalam petang pulak.. at around 5 pm... Boss tiba2 masuk ke bilik Mokcik...dengan muka serius.

"Mokcik, I want to see you and  *toot*  now in my room!  I want you to explain to me about the *toot* case..how did the Judge gave RM200k for *toot*???"

"*Tooot* boss? But she is not here, she is in *ToooT*"

Lama juga boss terdiam,..

"Ok you call her now and ask her pot pet pot pet pot pet.."

Adoiii...boss boleh tak jgn marah2..

kalau kami menang kes..takde sapa ucap tahniah tau... 

Tapi kalau kami kalah kes..teruk betul kena marah

kalau silap sikit, akan dikenang seumur hidup...yang kebaikan kita dah buat selama ni tak nampak langsung..

Memang itulah adat dunia kan....

Thousand apologies ya..agak lama Mokcik tidak mengemaskini blog mokcik. Bila masuk jer membuat lawatan mengejut tadi, baru perasan ada komen dari kenkawan yang belum dipublish semenjak 2 april tempohari.. banyak banyak minta mahap ya kenkawan.  

Remember my last posting? Mokcik terpaksa kuarantin diri sendiri untuk menyiapkan hujahan yang perlu disiapkan dan dihantar jauh nun ke Sabah Negeri Di bawah Bayu sana?

Alhamdulillah... hari khamis lepas, semasa Mokcik berada di ruang menunggu Mahkamah Persekutuan, mokcik menerima sms daripada rakan sekerja di Sabah.

"Salam Puan. Tahniah pada Cik T. Kes dot dot dot, Tuntutan plaintif ditolak dengan kos"

Cik T is the officer i assigned to go and handle the trial in KK. A junior officer, but i have faith in her. We, well, she faced loads of problem during the proceedings. We communicated a lot through the phone during that period, whenever possible, i gave guidance. Pegawai yang muda-muda ni masih malu-malu bila kena gertak dengan Hakim... disitulah peranan kita sebagai senior sangat penting untuk memberi motivasi dan cara-cara untuk 'handle' keadaan sedemikian.

Cik T told me the judge even scolded her and gave a hint, 'You should have settle this case.'

When she came back, we sat down together and discussed about the case. The prospect is not good.. All evidence are against us. The counsel for the Plaintiff kept on harrassing us, insisting us to settle the case. 

I then went and discussed the case with my boss. It was while discussing with her that suddenly  i saw some points that might be in our favour. 

Few days later, the Plaintiff sent us his submission. A three pages submission with only one case to support his argument.  Cik T prepared the draft submission... and she did a wonderful job. She did a very thorough research. The only hiccups, which is normal for all these young officers, are their ideas are all jumbled up.  And they are still not brave enough to use strong words, in other words, they are being polite in their submission. 

As i have said before, she did a very thorough research and many cases were cited to support our submission. Took me two days to edit the language and rearranged the contents. 

Menjelang jam 12 tengahari jumaat , baharulah tugas mokcik selesai. Setelah membaca hujahan tersebut berulang kali  dan berpuas hati dengan kandungannya, baharulah Mokcik minta Cik T untuk faks kan hujahan tersebut ke destinasinya.  

Syukur alhamdulillah keputusan memihak kepada kami. Berbaloi kerja keras yang dipamerkan oleh team kami.  Tahniah untuk my team dan diri sendiri hehehe... Yeszaaa....
